Renovation Consumer Rights in BC: Your Legal Protections 2025
Consumer Protection for Renovation in British Columbia
BC homeowners have significant legal protections when hiring renovation contractors. Understanding your rights helps you make better decisions and take action when contractors fail to deliver.
Consumer Protection BC
Consumer Protection BC oversees the licensing and conduct of businesses in BC, including some home improvement contractors. They handle complaints and mediation for qualifying disputes.
BC Builders Lien Act
The Builders Lien Act provides critical protections:
- 10% holdback: You have the right (and obligation) to withhold 10% of all payments made as a lien fund
- Lien period: 45 days after substantial completion for subcontractors to file liens
- Priority: Liens have priority over most other claims on your property
BC’s New Home Buyer Protection
For major renovations that technically create new living space (like laneway homes), the Homeowner Protection Act requires the builder to be a licensed residential builder and provide statutory warranties (2-5-10 coverage).
Small Claims Court
BC Small Claims Court handles disputes up to $35,000. Filing fee: $100–$200. Appropriate for: deposit disputes, incomplete work, deficient work, contract disputes. For amounts over $35,000, file in BC Supreme Court (requires a lawyer for most cases).
BBB and Online Reviews
Check the Better Business Bureau (bbb.org) for contractor complaints. Yelp, Google Reviews, and HomeStars all provide valuable insight into contractor history.
